SunBelt Xpress will assume liability for cargo loss and damage claims under the Carmack Amendment to the Interstate Commerce Act,
49 U.S.C. § 14706 et seq.
Concealed damaged claims must be reported within 5 business days and will be settled on a percentage of the actual manufacturer’s invoice cost.
SunBelt has the right to mitigate all claims as Repair and Reship if we think it is repairable back to top quality.
ALL GLASS TOPS, MARBLE/STONE AND ACRYLIC PRODUCTS WILL NOT BE PROCESSED AS A DAMAGE CLAIM IF NOT NOTED ON FREIGHT BILL AT TIME OF DELIVERY
No claims will be honored on shipments to a delivery service unless opened, inspected, and noted of any damage while our driver is present to verify.
We reserve the right, by I.C.C. Rules and Regulations, to have damages inspected by an agent of our choosing to determine whether they can be repaired or if a replacement is warranted: this includes the right to bring items back to our local repair professionals for inspection and/or repair.
No claim will be honored on merchandise that is no longer at the original delivery point unless pre-approved by someone with the SunBelt claims staff. This includes the customer’s home.
Damaged piece(s) must be kept in the original carton for inspection and return to Sunbelt or the factory. Failure to retain the original carton or wrapping along with all other packaging material could void the claim.
When “Must Open and Inspect” is listed in the body of your freight bill, all freight must be opened and inspected while the driver is there, unless pre-approved by someone with the Sunbelt claims staff.
No claims will be honored on items that are no longer at or have been moved from the original delivery location unless arrangements have been made with Sunbelt Xpress prior to moving the items to another location.
Do not place an order for a replacement piece(s) or have repairs made on a claim without authorization from the Sunbelt claim staff. This could cause the claim to be voided.
